As you will be aware, Heathrow Airport Limited (“HAL”) have based their entire Building Block Update
(“BBU”) and the figures within on the assumed success of their Application for a RAB adjustment to
compensate for revenue not achieved as a result of Covid-19 (the “Application”).

In Heathrow’s view, it is appropriate for the CAA, when considering countervailing
buyer power of an airport, to review evidence relating to airlines’ conduct and how it
impacts on the competitive conditions at the airport, for example:

Airport Limited (“HAL”) in the light of the very significant
changes and uncertainties brought about by:
▪ the severe impact of the Covid-19 pandemic on the aviation sector as a whole and
passenger numbers at Heathrow airport;
▪ the Court of Appeal’s decision setting aside the Airports National Policy Statement;
and
▪ HAL’s subsequent decision to pause its programme for expanding Heathrow airport
in the light of these developments (although it is appealing against the Court of
Appeal’s decision).
