If you do not meet the definition of a worker for an ATOL holder you must act in compliance with the ATOL Regulations.

A “worker for an ATOL holder” is defined in the ATOL Regulations as:

an individual who is:

  • (a) an officer of a company holding an ATOL
  • (b) a partner of a partnership holding an ATOL
  • (c) a member of a limited liability partnership holding an ATOL
  • (d) an employee of the ATOL holder or
  • (e) an agency worker supplied by a temporary work agency to work temporarily for and under the supervision and direction of the ATOL holder.     .     

Homeworking schemes have become a significant element of travel trade operations.

In the absence of a legal definition for “homeworker”, reference to a “homeworker” on this page means: “a homeworking travel agent as a self-employed travel professional, who operates their business from home, offering travel booking services to consumers”.

A homeworker as defined above, does not meet the definition of a “worker of an ATOL holder” and is subject to the requirements of the ATOL Regulations.

If the homeworker does not hold an ATOL, they must act as an agent for an ATOL holder or in an exempt category.
