Regulation 2017/373 becomes applicable on the 02 January
There is some uncertainty, due to Brexit, as to exactly
when, and in what format this regulation will be applied in the UK.
To be prepared for all eventualities, the CAA is publishing Regulation
2017/373 compliance matrices now, to allow service providers to review their
management systems etc, to ensure future compliance.
Services providers should use the compliance matrices as a
checklist to indicate their current state of compliance and where additional
work needs to be done to achieve compliance.
Service providers should complete the applicable compliance
matrices and submit them to the CAA at email@example.com in
accordance with the instructions contained therein by 29th November 2019
Regulation 2017/373 widens the
scope of the definition of ANSPs to include, (in addition to ATS, AIS, MET and
CNS), Air Traffic Flow Management (ATFM) and Airspace Management (ASM).
There is also a subset of requirements placed on ATS
providers for Air Traffic Safety Electronic Personnel (ATSEP).
Regulation 2017/373 specifically
requires that the CAA approve two ANSP procedures.
The Change Management procedure, which is applicable to all
service providers, and the Psychoactive Substance
procedure which is only applicable to Air Traffic Control providers.
The requirements for a change management procedure are
detailed in the compliance matrix for ANNEX III part OR. In addition, a
checklist is provided to assist in ensuring the compliance of this procedure
with the requirements.
When Service Providers are content that their change
management procedure meets all items in the checklist they are to submit them
to the CAA for approval at firstname.lastname@example.org.
The requirements for a Psychoactive Substance procedure are
detailed in the compliance matrix for ANNEX IV part ATS. There is currently no requirement for ATC
providers to submit their psychoactive substance
procedure to the CAA for approval, as the CAA is intending to publish
guidance on the content. Further
information on when submission for approval is required will be notified to all
relevant service providers at a later date.
