T D Europe Ltd - ATOL 9153 6 February 2013

T D Europe Ltd ATOL 9153 trading as Different Tracks has stopped trading with immediate effect. The company was based in Buckingham and sold Packages and Flight-Only trips.

The following information is for consumers who are due to travel and hold forward package and Flights-Only bookings.

The ATOL system has changed to help consumers to understand if their booking is ATOL protected. Part of these changes is the introduction of an ATOL Certificate, which ATOL holders’ or their authorised agents are now required to issue when a licensable booking is entered into, even if only a deposit is paid. The certificate identifies; what is protected by the ATOL scheme, who is protected and the ATOL holder who is providing the protection. There are three types of ATOL Certificate, ‘Package sale’, ‘Flight-Only sale’ and ‘Flight-Plus sale’. The introduction of the ATOL Certificate did not happen until October 2012. Some bookings affected by the failure of T D Europe Ltd may have taken place prior to this time; in which case you would not have received an ATOL Certificate. We have included advice for consumers who do not have an ATOL Certificate.

Consumers due to travel

No ATOL Certificate

If the booking was made between 30 April and 31 October 2012 T D Europe Ltd will have issued you with separate or combined documents that stated what is protected by the ATOL scheme, who is protected and the ATOL holder who is providing the protection for each element of the purchase. You should follow the instructions set out below.

Package bookings made direct with T D Europe Ltd

If you booked a package directly with T D Europe Ltd and were issued with an ATOL Certificate which states ‘Package sale’, and you hold scheduled, no frills or e-tickets, the flight remains valid, and you may choose to travel. There is however a risk those other elements of the package such as accommodation may not have been paid for and you may be asked to pay again for these services. Check with the accommodation or other service provider to confirm availability and the costs of repurchasing the services prior to travel. Depending on how you originally paid, you may be entitled to claim for your replacement elements from either the CAA or your credit card provider.

You can also choose not to travel and submit a claim for a refund. In order to submit a claim we require all the original documentation provided to you, and proof of payment to T D Europe Ltd along with the unused flight tickets, which we will verify with the airline. Your claim may therefore take longer to process.

If you booked a package directly with T D Europe Ltd and were issued with an ATOL Certificate which states ‘Package sale’, but have not been issued with schedule, no frills or e-tickets you will not be able to travel proceed to the claim form and guidance document below.

Flight-Only bookings

If you booked just flights with T D Europe Ltd and you have been issued with scheduled, no frills or e-tickets you will be able to travel as normal. Passengers are advised to check with the Airline as per their existing flight ticket.

If you booked just flights with T D Europe Ltd and have been issued with an ATOL Certificate which states ‘Flight-Only sale’ in the bottom right hand corner and have not been issued with flight tickets, the flight will not be operating and you should fill in the claim form
